Sabuy Express Co., Ltd. (“Sabuy Express” or the “Company”) provides international document and parcel shipping services by air and sea, which may be carried out through airlines, shipping lines, freight forwarding agents, domestic service providers, customs brokers, or other third-party service providers. Payment of service fees, delivery of goods, signing of documents, or confirmation of service use through any Company channel shall constitute the Sender’s acknowledgement and acceptance of the following terms and conditions.
The Company reserves the right to refuse, suspend, return, surrender to government authorities, or otherwise handle in accordance with applicable law any of the following goods:
Any transit time quoted by the Company is an estimate only and does not constitute a guaranteed delivery date unless otherwise specifically agreed in writing.
Transit time may change due to customs or quarantine inspections, flight or vessel delays, weather conditions, strikes, natural disasters, war, epidemics, system failures, actions or procedures of government authorities, or other circumstances reasonably beyond the Company’s control.
The Company will make reasonable efforts to monitor and coordinate the resolution of delays but does not guarantee the release time of goods by government authorities or third-party service providers.
The Company shall not be liable for loss of profit, loss of opportunity, or indirect damages arising from delays, except as otherwise required by applicable law.4.2 Transit time may change due to customs or quarantine inspections, flight or vessel delays, weather conditions, strikes, natural disasters, war, epidemics, system failures, actions or procedures of government authorities, or other circumstances reasonably beyond the Company’s control.
If the Sender has not purchased additional coverage and the Company’s investigation establishes that the goods were lost or damaged due to the Company’s operations, the Company will consider compensation for proven direct loss, up to a maximum of AUD 50 per waybill or Shipment.
Compensation shall not exceed the actual purchase price of the affected goods. The claimant must provide a receipt, invoice, or other verifiable evidence of value.
The AUD 50 limit is an aggregate limit per waybill or Shipment, not per box, item, or product line.
If payment is made in another currency, the Company will calculate the amount using the exchange rate applied by the Company on the date the compensation is approved.
Compensation under this clause does not include anticipated profit, sentimental value, loss of time, reputational damage, or other indirect loss, except as otherwise required by applicable law.
The limits and restrictions under this clause apply to the extent permitted by law and do not exclude any rights that cannot lawfully be excluded under the Australian Consumer Law.
To the extent permitted by law, the Company may not be liable for loss or damage arising from any of the following causes:
The Sender may purchase additional coverage before export, subject to a fee of 3% of the full declared value of the goods, with a minimum charge of AUD 30.
Additional coverage shall take effect only after the Company has received full payment of the coverage fee and has confirmed the coverage in writing before the export date.
This coverage applies only where the entire Shipment is lost, including theft resulting in the complete loss of the Shipment and failure to deliver the Shipment to the Consignee.
The compensation amount shall be based on the actual purchase price supported by evidence or the declared and approved value, whichever is lower.
This coverage does not cover partial damage or loss, including:
– Dented boxes, scratches, pressure marks, or deformed packaging.
– Goods that are broken, cracked, damaged, or otherwise defective.
– Water or moisture entering the goods or packaging.
– Goods that spoil, melt, deteriorate, or expire.
– Loss of only some boxes or individual items.
– Delays in transportation.
– Seizure, detention, destruction, or refusal by government authorities.
– Prohibited goods, incorrectly declared goods, or goods without the required permits or documentation.
– Loss of profit, loss of opportunity, or indirect damages.
If the Shipment is not completely lost but goods are partially damaged or partially lost, the claim will be considered under Clauses 5 and 6 and not under the additional coverage limit.
The Company will issue written confirmation to the Sender specifying the Shipment number, covered value, coverage commencement date, and applicable exclusions.
In the event that goods are damaged, wet, or the packaging is damaged, the Consignee must notify the Company in writing as soon as possible and should do so within 24 hours after receipt of the goods.
In the event of missing goods or suspected loss, the Sender must notify the Company within 7 days from the date the goods were received or the date on which the goods should have been received according to the tracking information.
The claimant must provide relevant supporting evidence, including:
– Waybill or Shipment number.
– Receipt or invoice showing the value of the goods.
– Photographs of all sides of the package before opening.
– Photographs of the label, seal, and tracking number.
– Photographs of the goods and the damaged areas.
– A list of lost or damaged goods.
– A list of lost or damaged goods.
– Any other documents or information reasonably requested by the Company.
The Consignee must retain the goods, box, cushioning materials, packaging, labels, and seals in their original condition until the Company confirms that its investigation has been completed.
Failure to notify within the specified period or failure to retain supporting evidence may prevent the Company from determining the cause and may affect the assessment of the claim. However, this period does not limit any rights that cannot be excluded under applicable law.
The Company will commence its assessment once all required evidence has been received and will provide an initial result within 3 business days. If further investigation with an airline, shipping line, customs authority, or other agent is required, the Company will advise of the additional processing time.
Acceptance of a claim or a request for additional evidence does not constitute an admission of liability, the cause of damage, or the amount of compensation.
Once the Company and the claimant agree on the compensation amount, the Company may require the claimant to sign a compensation acknowledgement before payment is made.
